This Writ Petition is filed alleging interference by the respondent police with the petitioner’s life and liberty by frequently summoning him to the police station without there being any criminal cases against him.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home, appearing for respondents No.1 to 3.

Learned counsel for the petitioner submitted that there are matrimonial disputes between the petitioner and his wife and that the same are being resolved through the intervention of the village elders. It is further submitted that, at the instance of petitioner’s wife, the respondent police are repeatedly summoning the petitioner to the police station under the guise of settlement and are threatening to implicate him in a false criminal cases. Aggrieved by the said action, the present Writ Petition has been filed.

Learned Assistant Government Pleader for Home has furnished a copy of the written instructions received by him and submitted that the petitioner and his wife, along with their elders, approached respondent No.3 in connection with their matrimonial dispute. It is submitted that both of them quarreled with each other but they have not lodged any complaint before the respondent police. It is further submitted that the parties were advised to lodge a complaint if they had any grievance, however, as on date, neither party has lodged any complaint. Therefore, the allegations that the petitioner is being repeatedly summoned to the police station and harassed him are denied.

In view of the above facts and circumstances, this Court directs the respondent police not to call the petitioner to the police station without any justifiable cause.

With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed.
