This Original Application has been registered on a letter petition dated 23.01.2023 sent by one Mahesh Kumar, R/o A-47, New Seelampur, Garhi Mendu, North East Delhi. The matter was considered by the Tribunal on 13.03.2023 and in its order of the said date, grievance of the applicant was noticed, that M/s New Global Industries is operating at Bawana, near residential area of applicant and its operations are causing severe environmental pollution in the vicinity. The industry is a large-scale industry carrying out environmental degradation by manufacturing nuts, bolts and fasteners which includes disposal of various trade effluents such as air/smoke, noise, electroplating chemicals and chemicals produced by zinc plating using acids and other hazardous waste without any treatment. The industry is owned by Mr. Arvind Bansal and located at M47 and M2, DSIIDC Industrial Area, Bawana, Delhi. The factory is also being run at a place where such commercial and industrial activities are not permissible. It is also openly dumping industrial waste and garbage on road side and discharging untreated sewage in violation of environmental laws. The industry falls in red category and is not permitted even otherwise in the area where it is functioning.

After noticing the complaint made by the applicant, this Tribunal

found it appropriate to constitute a joint Committee so as to obtain a factual and action taken report after visit of the site and collection of relevant information by the joint Committee comprising DPCC, CPCB and District Magistrate, North Delhi.

Pursuant to our order dated 13.03.2023, a report dated 16.05.2023 has been filed wherein it is stated that the sites of M/s New Global (India), M-2, Sector 5 Bawana Industrial Area and M-47, Sector 5 Bawana Industrial Area were visited on 10.04.2023 and it was found that the units

were in operation; they are non-water and air polluting industries involved in the process which comes in ‘White’ category and the units have obtained consents from the concerned authorities in ‘white’ category.

The observations made in the report read as under:-

·    No  effluent  and  emission  discharge  were found.

·    No water polluting activity.

·    Activity  carried  out  by  unit  falls,  in  white category.

·    Unit   has   obtained   Consent   certificate   in white category.

M-47 Sector 5 Bawana Area Industrial

·    Unit found in operation and engaged in the activity of Mfg. of Nuts and fasteners.

·    Unit is involved in Light Engineering Works i.e., Manufacturing of screw process involved

cutting, stretching, taping etc., which is non water/ air polluting in nature.

·    No  effluent  and  emission  discharge  were found.

·    No water polluting activity.

·    Activity  carried  out  by  unit  falls,  in  white category.

·     Unit  has  obtained  Consent  certificate  in white category.

Again units were inspected on 25.11.2022 and the observations are that both the units were in operation, working with consent and not causing any pollution whether in regard to water or air. We find no reason but to accept this report.

In view thereof, we do not find that any further action is required in the matter.

Accordingly, the application stands disposed of.
