Grievance in this application is against illegal commercial activities in residential area (Street No.5 Main Road, Subhash Park, Naveen Shahdara, Delhi-32 North-East Zone) causing noise and air pollution and environment damage by the following industries.

1) Fabricator (unauthorized Factory) Owner: Mr. Parvez Rajput.

Add: 1/10685, A, Street no.5, Main Road, Subhash Park Naveen Shahdara, Delhi-110032.

2) Scrap Dealer Factory (unauthorized Factory) Owner: Mr. Sushil Gupta

Add: Adjacent to Grand Tailor (1/10683), Street no.5, Main Road, Subhash Park Naveen Shahdara, Delhi-110032.

Vide order dated 24.01.2022, a joint Committee of DPCC, EDMC, DCP, Shahdara and the District Magistrate, Shahdara was required to furnish a factual report in the matter.

In  pursuance  of  above,  a  report  has  been  filed  by  DPCC  on 11.03.2022 as follows:

“2. That, in compliance of the orders passed by this Hon'ble Tribunal, the unit was inspected by joint team consisting officials of DM, Shahdara, EDMC, DCP, Shahdara and DPCC on 18.02.2022 and during field visit, it was gathered that M/s Parvez Rajput, 1/10685,A, Street No.5, Main Road Subhash Park, Naveen Shahdara, Delhi-110032 was engaged in the activity of Light Engineering Work (Fabricating Items). However, at the time of inspection the premises was found vacant but traces of past activity was noticed. The premises of the unit from where it was operating at first floor were sealed on the spot i.e. 1st floor. M/s Parvez Rajput has been issued show cause notice for imposition of Environmental Damage Compensation. Copy of SCN is annexed as Annexure-1.

It is also submitted that the other unit M/s Sushil Gupta Adjacent to Grand Tailor (1/10683), Street no.5, Main Road, Subhash Park Naveen Shahdara, Delhi-110032 was also inspected on 18.02.2022and it was gathered that the premises was being used as scrap godown. However, at the time of inspection the premise was found vacant. The officials of the EDMC confirmed that on inspection dated 27.07.2021 the premise was also found vacant.”

In view of above, no further order appears to be necessary at this stage.
