Judgment
ORDER:
The Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of respondent Nos.2 to 5 in not renewing the petitioner's Commission Agent Licence by changing the name of the Proprietor from Kavuru Lakshmi Devi (died on 27.11.2017) to Nagella Manjula, in respect of Licence No.514/2013-2018, for a further period, despite the representation dated 12.06.2023 submitted by the petitioner, as illegal, arbitrary, contrary to the provisions of the Andhra Pradesh (Agricultural Produce and Livestock) Markets Act, 1966, as amended by Act 14 of 2015, and the Rules made thereunder, violative of principles of natural justice and Articles 14, 19(1)(g) and 21 of the Constitution of India, and consequently direct the respondents to renew the said licence.”
Heard Sri Venkata Rao Penumaka, learned counsel for the petitioner, and Sri G. Rajaeswara Rao, learned counsel for the Agricultural Market Committee (AMC).
Learned counsel for the petitioner would submit that the Writ Petition may be disposed of giving liberty to the petitioner to submit a fresh representation before the respondent authorities and to consider the same in accordance with law. He further submits that the petitioner may be permitted to submit an application in Form-5(C) and the respondent authorities may be directed to consider the same within a time frame.
Learned Standing Counsel appearing for the AMC would submit that appropriate orders may be passed.
In view of the submissions made by the learned counsel for both sides, the Writ Petition is disposed of giving liberty to the petitioner to submit a fresh representation along with an application in Form-5(C) before the respondent authorities within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondent authorities shall consider the same and pass appropriate orders, in accordance with law, within a period of two weeks thereafter. There shall be no order as to costs.
As a sequel, miscellaneous applications, if any, pending in this Writ Petition shall stand closed.
