Heard learned counsel for the petitioner, Mr. K. Ravi Mahender, learned standing counsel for respondents No.2 and 3 – GHMC and Mr. N. Sreedhar Reddy, learned standing counsel for respondents No.4 to 6 - TGSPDCL.

The case of the petition is that building permission was granted to the petitioner vide permit No.5518/GHMC/SLP/2025-BP dated 31.11.2025 for construction of Stilt for Parking + 4 Upper Floors. However, as against that, the petitioner constructed Stilt + 5 upper floors. The entire Stilt + 5 upper floors have been sealed and thereafter, power supply has been disconnected by the respondents No.4 to 6, on the request of the respondent No.3.

As it is stated by the learned counsel for the petitioner that Stilt + 4 upper floors have been constructed in accordance with the sanctioned plan and not rebutted by the learned standing counsel for GHMC, the respondent No.3 ought to have confined sealing only to the extent of unauthorized fifth (5th) floor. Hence, the sealing, if any, effected on the Stilt + 4 upper floors shall be removed forthwith. Consequently, the respondent No.5 is directed to restore power supply forthwith to Stilt + 4 upper floors. As admittedly, the fifth (5th) floor has been unauthorizedly constructed by the petitioner, the respondent No.3 is at liberty to take action in accordance with law. However, the petitioner is also at liberty to take necessary steps by filing an application for regularization under Sections 455A and 455AA of the GHMC Act, 1955.

The writ petition is accordingly disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
