The present application has been filed on behalf of Operational Creditor Mr. Arshad Imam for restoration of application under Section 9 of the IBC, 2016 for initiation of CIRP of CP IB No. 3430/2019.
Mr. Anuj has appeared on behalf of petitioner informed that his client has already received the demand draft.
Mr. Anuj has appeared on behalf of petitioner and in course of hearing submitted, Arshad Imam informed that he has already received the amount of Rs. 201380/- vide DD No. 277134 dated 04.09.2020 and he has also appeared before us through VC and admits that he has received that amount today and he has satisfied with the amount.
Ms. Nishi has appeared on behalf of respondent and also informed that demand draft of Rs. 201380 vide DD No. 277134 dated 04.09.2020 has already been paid to Mr. Arshad Imam.
Considering these facts, since the debt has been satisfied, therefore, this application has becomes infructuous.
Accordingly, the present application stands dismissed as it becomes infructuous.
