Principal amount due from 07/12/2018 amounting to Rs.10,20,051.00 and interest amount @ 9% from 07/12/2018 to 15/10/2022 amounting to Rs.3,54,391.68 have been tendered in the Court by way of two Demand Drafts being D.D. No.025708 dated 23/09/2022 for Rs.10,20,051.00 and D.D. No.025730 dated 01/10/2022 for Rs.3,54,392.00 both drawn in favour of the Operational Creditor, Jay Baba Bakreswar Rice Mill (P) Ltd. This matter was listed yesterday, i.e., 11/10/2022, and the Ld. Counsel appearing for the Operational Creditor sought time to seek instructions from her client. Counsel, appearing for the Operational Creditor in virtual mode states that upon instructions the amount tendered by the Corporate Debtor is accepted by the Operational Creditor. The Demand Drafts has been received in the Open Court by Ms, Tanishka Khandelwal, Ld. Counsel, appearing physically on behalf of the Operational Creditor. Accordingly, Ld. Counsel for the Operational Creditor seeks permission to withdraw the CP(IB)/490(KB)2019. Permission is granted.
CP(IB)/490(KB)2019 is, accordingly, dismissed as withdrawn.
