It is submitted by Mr. S.P. Sinha, learned Counsel for the Appellant that the Appellant was granted bail u/s 167 (ii) Code of Criminal Procedure in February 2003 and, thereafter, bail bonds were cancelled and warrant of arrest was issued on 02/05/2003, whereas the sanction for prosecution was received later on and the cognizance was taken on 30/07/2005; and that the Appellant was taken into custody in connection with another case; and that he has remained in custody for about two and half years after the alleged misuse.
In the circumstances, the Appellant Lokan Ganjhu is directed to be released on bail on furnishing bail bonds of Rs. 10,000/ (ten thousand) with two sureties of the like amount each to the satisfaction of the trial court (Judicial Commissionercum Special Judge, Ranchi) in connection with Special Case No. 74 of 2002(P), arising out of Ichak P.S. Case No. 65 of 2002, G.R. No. 1109 of 2002, subject to the conditions that one of the bailers will be his close relative and the other should have landed property within the local jurisdiction of the Court and the Appellant will attend the trial regularly on each and every date and if he fails to appear even on a single date his bail bonds shall stand cancelled automatically.
With these observations and directions, this appeal stands disposed of.
