Judgment
This Civil Revision Petition has been filed under Article 227 of the Constitution of India seeking expedite disposal of O.S.No.91 of 2022 pending on the file of the Principal Junior Civil Judge- cum-Judicial Magistrate of First Class at Kothagudem.
Heard Mr. R.R.Kalyan, learned counsel for the petitioner. Notice in respect of respondent Nos.1 and 2 is dispensed with on the ground that the petitioner is not seeking any relief against them and only seeking disposal of the suit O.S.No.91 of 2022.
Learned counsel for the petitioner submitted that respondent No.1 filed a suit O.S.No.91 of 2022 before the Principal Junior Civil Judge-cum-Judicial Magistrate of First Class at Kothagudem against the petitioner and respondent No.2 for grant of perpetual injunction, restraining them from interfering with the suit schedule property. In the said suit, the petitioner has filed counter on 18.08.2022 seeking declaration, declaring them as owners of the suit schedule property. Learned trial Court, without considering the said suit adjourning the matter. Unless this Court issue necessary direction to the learned trial Court for expedite disposal of O.S.No.91 of 2022 by fixing time limit, the petitioner will be put to great hardship.
In view of the above, without expressing any view on the submissions made by the learned counsel for the petitioner, learned trial Court is directed to dispose of O.S.No.91 of 2022, in accordance with law, as expeditiously as possible. It is made clear that the parties in lis shall cooperate with the trial Court for disposal of O.S.No.91 of 2022 without seeking undue adjournments.
Accordingly, the Civil Revision Petition is disposed of. Miscellaneous applications, pending if any, shall stand closed.
