Judgment
This Civil Revision Petition has been filed by the petitioner/plaintiff under Article 227 of the Constitution of India, seeking a direction for expeditious disposal of the final decree proceedings in I.A.No.1020 of 2011 pending before the learned Agent to Government, Bhadradri Kothagudem (for short, 'the trial Court').
Heard Mr. R.R. Kalyan, learned counsel for the petitioner.
Notice to the respondents is dispensed with, on the ground that the petitioner is not seeking any effective relief against them, and is only seeking a direction for the expeditious disposal of the proceedings pending before the trial Court.
Learned counsel for the petitioner submitted that the petitioner filed a suit in O.S.No.346 of 2005 seeking partition and separate possession of the suit schedule property and that a preliminary decree was passed on 17.08.2007. Thereafter, the petitioner filed I.A.No.1020 of 2011 for passing of a final decree. The said application has been pending since 2011. Unless this Court issues necessary directions to the learned trial Court to dispose of I.A.No.1020 of 2011 within a stipulated time, the petitioner will be put to great hardship, as he has been deprived of enjoying the fruits of the preliminary decree passed in his favour for a long period since 17.08.2007.
Taking into consideration the submissions made by the learned counsel for the petitioner and without expressing any view on the merits of the case, this Court directed the learned trial Court to dispose of I.A.No.1020 of 2011, in accordance with law, as expeditiously as possible, preferably within a period of one (1) month, from the date of receipt of a copy of this order. The parties to the lis are directed to extend their cooperation to the learned trial Court without seeking undue adjournments.
With the above directions, the Civil Revision Petition is disposed of. No costs.
Miscellaneous applications, pending if any, shall stand closed.
