Notice of the complaint to Respondent No. 1 was given dasti.
The Authorized Representative of the Complainant submitted that since the promoter or his office staff was not found at the address, they had pasted the notice at the given address. Complainants have placed photo of the fixation of notice on records. However, the photo is neither clear nor the address of the property nor the contents of the notice nor the date of the affixation is visible in the photographs.
The notice to the Respondent No. 1 was also sent to the DCP, EOW. Report has been received from Sh. Kamal Kishor, Inspector EOW stating that the notice to M/s Best View Properties Ltd. has been duly served on the address IIFL House No. 119, Defence Enclave, Ground Floor, Near DDA Market Delhi-92 served on Sh. Rohit Mobile No. 9999911114.
However, none has appeared for the Respondent No. 1. In the interest of justice, one opportunity is granted them to file a reply by 25.02.2024 with copy served on the Complainant.
Complainants may file rejoinder, if any, by 10.03.2024 with copy served on the Respondents.
Respondent No. 2 has filed reply to which rejoinder has been filed by the Complainant and copy served on the Ld. Counsel for the Respondent No. 2.
