2/29.07.2026 Heard learned counsels for petitioners and for State.

The petitioners are apprehending their arrest in connection with Jirwabari PS Case No.62 of 2026, for offence registered under section 126(2), 115(2), 118(1), 118(2), 117(2), 109(1), 333, 326(g), 324(5), 96, 351(2), 352, 3(5) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Sahibganj.

Learned counsel for petitioners submits that the petitioner no.1 is the father of Muni Lal Sah and Muni Lal Sah was having relationship with the victim who is the daughter of the informant.

He next submits that false allegations are made of putting the house on fire. He next submits that now the said Muni Lal Sah and the victim has solemnized marriage and both families have compromised the matter by way of Annexure-2, and in that view of the matter, anticipatory bail may kindly be granted.

Learned State counsel opposes prayer and submits that allegations are there of putting the house on fire and in view of that anticipatory bail may kindly be rejected.

Annexure-2 is the document which clearly suggest that both the parties have compromised the matter and it has been pointed out that Muni Lal Sah is the son of the petitioner no.1 and marriage of the victim has been solemnized with said Muni Lal Sah, and in the facts and circumstances of the instant case, I am inclined to grant anticipatory bail to petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Sahibganj, in connection with Jirwabari PS Case No.62 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
