The grievance in this application sent by Mr. Hirdey Kumar Goel and others residents of New Ashoka Co-Op H.B, Sociey Ltd., Ashoka Bhavan, Ashoka Niketan, Delhi is against construction of convenient shopping center in Ashoka Niketan (Anand Vihar). The applicants have claimed that the above said colony is surrounded with many number of markets including Savita Vihar, Surajmal Vihar and Shreshta Vihar Shopping Complex and construction of the convenient shopping center is not required and will also breach security and privacy of the residents. The builder has insensibly chopped many trees and is not following prescribed building norms and laws and has not covered the construction site with sheets and green mats to check environmental pollution. Diesel generators and mixture makers are being used which are also emanating smoke/foul smell and causing environment pollution. The builder is also using submersible pump and drawing groundwater in gross violation of law.

In view of the averments made in the application the factual position needs to be verified and remedial action is required to be taken on the basis thereof by the concerned Statutory Authorities. We accordingly constitute Joint Committee of DPCC, Deputy Conservator of Forests (Central Division), Delhi and Deputy Commissioner (Shahdara) Delhi and direct the same to verify the factual position, look into the grievances of the applicant and take remedial action in accordance with law by following due process within one month from the date of receipt of a copy of this order. The DPCC will be the Nodal agency for coordination and compliance.

Factual and action taken report may be furnished within two months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF, before the Ld. Registrar General, National Green Tribunal, Principal Bench, New Delhi who may, if necessary, put up the matter before the Bench for further directions.

The application is disposed of accordingly.

A copy of this order along with a copy of the application be forwarded to the DPCC, Deputy Conservator of Forests (Central Division), Delhi and Deputy Commissioner (Shahdara) Delhi by e-mail for compliance.
