Madhu Sharma vs Govt. of NCT of Delhi

Madhu Sharma resident of K-130, Gautam Nagar, New Delhi has sent this letter petition, which is treated and registered as original application, complaining that commercial activities are being run in upper ground floor of residential building no. K-130, Gautam Nagar, New Delhi without permission. Flat constructed as per the approved site plan has been demolished to convert the same to kitchen for the hotel and one big generator set has been installed by making encroachment in violation of approved site plan. The Generator is causing air pollution and she and her family are suffering physically and mentally. Her mother, who is a senior citizen, is facing difficulties in breathing. She made complaints to the concerned authorities but no action has been taken so far.

In view of the grievances made in the letter petition, we consider it appropriate that a Committee of the concerned authorities be asked to verify the factual position and take remedial action on the basis thereof. We accordingly constitute Joint Committee of DPCC and District Magistrate, (South) Delhi and direct the same to verify the factual position, look into the grievances of the applicant and take remedial action in accordance with law after following due process.

Factual and action taken report may be furnished within two months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF, before the Ld. Registrar General, National Green Tribunal, Principal Bench, New Delhi who may, if necessary, put up the matter before the Bench for further directions.

The application is disposed of accordingly.

A copy of this order, along with a copy of the application, be forwarded to the DPCC and District Magistrate, (South) Delhi by e-mail for compliance.
