Judgment
2/05.08.2026 Heard learned counsels for petitioners and for State.
The petitioners are apprehending his arrest in connection with Dhurwa PS Case No.125 of 2021, for offence registered under section 414 IPC, Section 4 and 21 of Mines and Minerals (Development and Regulation) Act, 1957, Rule 54 of Jharkhand Mines and Minerals Concessions Rules, 2004 and Rules, 7,9 and 13 of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017 pending in court of learned Chief Judicial Magistrate, Ranchi.
Learned counsel for petitioners submits that the petitioners are not named in the FIR and the case is lodged against 23 named accused including Mangru Oraon and said Mangru Oraon has been granted anticipatory bail in ABA No.4565 of 2022. He next submits that the allegation of excavation is there against other accused persons and the petitioners are the owners of three different tractors and due to that, the name of the petitioners has come and they have received notice under section 41-A of the Cr.PC.
Learned State counsel opposes prayer and submits that petitioners are said to be owners of three different tractors.
By way of Annexure-3 series, the co-accused persons have been granted anticipatory bail and the petitioners are not named in the FIR and they are said to be owners of three different tractors and it has been pointed out that they are having no knowledge about the said tractors of being used in illegal excavation and the petitioners are having no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioners.
Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Ranchi, in connection with Dhurwa PS Case No.125 of 2021, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
