Judgment
2/11.08.2026 Heard learned counsels for petitioners and for State.
The petitioners are apprehending their arrest in connection with Balumath P.S. Case No.165 of 2023, for offence registered under section 379 /413 of IPC and Section 30(ii) of Coal Mines Act and Section 21 of Mines and Minerals (Development and Regulation) Act, 1957 and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned Chief Judicial Magistrate, Latehar.
Learned counsel for petitioners submits that the petitioners have nothing to do with the alleged allegation of unloading the coal at another place. He next submits that these petitioners are not named in the FIR however the names of the petitioners have surfaced in course of investigation and the petitioners are having no criminal antecedent as disclosed in paragraph no.15 of the petition.
Learned State counsel opposes prayer and submits that the name of the petitioners have surfaced in course of the investigation and in view of that anticipatory bail may kindly be rejected.
Allegations are made unloading the coal at another place by the Hywa vehicle in question in place of Basia Siding and the petitioners are not named in the FIR and they are having no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioners.
Accordingly, both the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Latehar, in connection with Balumath P.S. Case No.165 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
