Judgment
2/29.07.2026 Heard learned counsels for petitioners and for State.
The petitioners are apprehending their arrest in connection with Complain Case No.35153 of 2025, for offence registered under section 9 and 11 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage), Rules, Section 4 and 21 of Mines and Minerals (Development and Regulation) Act, 1957 and Rule 54 of Jharkhand Minor Mineral Concession Rule, 2004, pending in court of learned A.C.J.M., Ranchi.
Learned counsel for petitioners submits that the petitioner no.1 is the owner and the petitioner no.2 is the driver of the tractor in question and the allegations are made of carrying 100 cft sand on the said tractor and the said sand was booked by another person and the petitioners are having no criminal antecedent as disclosed in paragraph no.13 of the petition.
Learned State counsel opposes prayer and submits that the allegations are there of illegally carrying the said sand on the tractor in question.
Considering that petitioner no.1 is the owner and the petitioner no.2 is the driver of the tractor in question and the said sand was booked by another person and the petitioners are having no criminal antecedent as disclosed in paragraph no.13 of the petition, I am inclined to grant anticipatory bail to both the petitioners.
Accordingly, both the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned A.C.J.M., Ranchi, in connection with Complain Case No.35153 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
