Judgment
2/29.07.2026 Heard learned counsels for petitioner and for State.
The petitioner is apprehending his arrest in connection with Mayurhand PS Case No.66 of 2025, for offence registered under section 303(2), 317(5), 3(5) of BNS, 2023, section 21 of Mines and Minerals (Development and Regulation) Act, 1957, Rule4 and 54 of Jharkhand Minor Minerals Concession Rules, and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, pending in court of learned Judicial Magistrate First Class Chatra.
Learned counsel for petitioner submits that the petitioner happened to be driver of the tractor and the allegations are made of carrying 100 cft sand on the said tractor. He next submits that the said sand was booked by another person and the petitioner has got no criminal antecedent as disclosed in paragraph no.13 of the petition and petitioner earns his livelihood by way of driving the said tractor and the owner cum driver of another tractor has been granted anticipatory bail in ABA No.46 of 2026.
Learned State counsel opposes prayer and submits that illegally the said sand was being carried in the said tractor.
Considering that the petitioner is driver and it has been pointed out that the petitioner earns his livelihood by way of driving the said tractor and he has got no criminal antecedent as aforesaid and owner cum driver of another tractor has been granted anticipatory bail in ABA No.46 of 2026, I am inclined to grant anticipatory bail to the petitioner.
Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class Chatra, in connection with Mayurhand PS Case No.66 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
