The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to re-issue his passport.

The petitioner was issued passport on 24.10.1989. The petitioner left for Germany on 13.11.1992. The petitioner lost his passport in Germany. The petitioner was re-issued passport which was valid upto 10.07.2022. The petitioner again lost his passport and he reported this fact to Mantua Police (Italy). The petitioner came back to India on the basis of emergency travel certificate. An FIR No.55 dated 02.09.1991 under Sections 406, 467 and 468 of Indian Penal Code, 1860 was registered against the petitioner. The petitioner has been acquitted by the Trial Court still respondent has not re-issued passport.

Learned counsel for the respondents submits that petitioner was issued a notice dated 28.04.2023, however, he did not respond. The petitioner may be directed to appear before passport authorities and clarify his position.

He assures the Court that an appropriate order would be issued within six weeks from the date of his appearance.

Learned counsel for the petitioner agrees to aforesaid arrangement.

In the wake of statements of both sides, the present petition stands disposed of with a direction to the petitioner to appear before Passport Authority on 09.01.2023 at 10:00 AM along with requisite documents.
