The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue him passport.
An FIR No. 07 dated 13.01.2021, under Sections 354, 341, 506, 427, 148, 149 of IPC and Sections 3, 4 of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 was registered against the petitioner at Police Station Sadar Zira, District Ferozepur. The police filed cancellation report on 04.02.2022 and it has been approved on 18.05.2023, however, report has still not been filed in the court.
Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order.
Learned counsel for the petitioner agrees to the aforesaid arrangement.
The petitioner is directed to appear before the passport authority on 05.01.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order, in accordance with law, within six weeks from 05.01.2024.
The petition stands disposed of.
