The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue him passport.
Learned counsel for the petitioner inter alia contends that petitioner was issued passport on 06.08.2001 which expired on 05.08.2011. An FIR No. 78 dated 20.11.2012 was registered against the petitioner. Vide judgment dated 06.07.2015, he was convicted and awarded sentence of 10 years. He preferred CRA-S- 3620-SB of 2015 before this Court. Sentence of the petitioner was suspended by this Court vide order dated 18.04.2017. He applied for re-issuance of passport on 17.11.2022 but till date passport has not been issued to him.
Notice of motion.
Ms. Bhawna Thakur, Central Government Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service. She submits that petitioner may be directed to appear before the passport authority alongwith requisite documents. Thereafter, the passport authority would pass an appropriate order within six weeks.
Learned counsel for the petitioner agrees with the aforesaid arrangement.
In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 22.02.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 22.02.2024.
