The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to issue him passport.
The petitioner was issued passport on 13.01.2005 which was valid upto 12.01.2015. The petitioner applied for re-issuance of passport vide application dated 23.10.2023. An FIR No. 44 dated 07.05.2014, under Sections 279, 304, 337, 338, 420 and 427 of IPC was registered against the petitioner at Police Station, Sarai Amanat Khan, District Tarn Taran. The petitioner was convicted vide judgment dated 15.12.2016 passed by Additional Sessions Judge, Tarn Taran. The petitioner preferred CRA-S-20-SB of 2017 before this Court. Sentence of the petitioner was suspended vide order dated 11.01.2017 passed by this Court.
Counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391.
Counsel for Union of India, who on advance notice is present in Court, submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within six weeks.
Counsel for the petitioner agrees to the aforesaid arrangement.
In the wake of statements of both sides, the present petition is disposed of with a direction to petitioner to appear before the passport authority on 08.01.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order, in accordance with law, within six weeks from 08.01.2024.
