This is a petition under Article 226/227 of the Constitution of India for the issuance of a writ in the nature of certiorari for quashing of the impugned order dated 17.05.2023 (Annexure P-3) passed by respondent No.2 whereby respondent No.2 had dismissed the revision petition filed by the petitioner against the order dated 09.05.2019 (Annexure P-1) passed by respondent No.3.

Learned counsel for the petitioner has submitted that inadvertently, neither the enquiry report dated 25.07.2018 nor the order dated 26.12.2018 have been annexed or have been challenged, nor the order dated 09.05.2019 (Annexure P-1) has been challenged, thus, the petitioner seeks to withdraw the present writ petition with liberty to file a fresh petition after annexing all the aforesaid documents and also after making an appropriate prayer.

Dismissed as withdrawn, with the aforesaid liberty.

It is made clear that in case any such petition is filed by the petitioner, then, all the issues including the issues of maintainability and delay would be considered, in accordance with law.
