Judgment
The present writ petition is filed seeking the following prayer:
"...to issue a writ order or direction more particularly one in the nature of writ of Mandamus directing respondent No.3 grant protecting during construction of the Fence/Boundary walls in the Total property open plot in Survey No.822/1, to extent of 3000 square yards, Chinta Bavi, Chiklakguda, Hyderabad and pass..."
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondents No.1 to 3.
Learned counsel for the petitioner has placed reliance upon the orders of this Court in W.P. No.15617 of 2021, dated 12.07.2021, and the order of the Division Bench in W.A. No.359 of 2021, dated 13.08.2021, and submitted that the petitioners therein were permitted to put up barbed-wire fencing around the subject land at their own expense and risk. It is further submitted that, despite submitting a representation, the respondents are not providing police protection. Aggrieved thereby, the present writ petition is filed.
Learned Assistant Government Pleader for Home has produced a copy of the written instructions, wherein it is stated that the petitioner has not approached the respondents with any representation as alleged. It is further stated that, if any grievance is raised in future and the petitioner lodges a complaint, necessary action will be taken in accordance with law.
In view of the same, at this stage, learned counsel for the petitioner submits that the petitioner would submit a detailed representation afresh and seeks a direction to the respondents to consider the same.
In view of the above submissions, this writ petition is disposed of directing the petitioner to submit a detailed representation to the competent authority and, upon receipt of such representation, the respondents shall consider the same and take appropriate action in accordance with law, expeditiously. No order as to costs.
As a sequel thereto, all miscellaneous applications, if any, pending in this Writ Petition shall stand closed.
