Judgment
Head Mr. P. Shiva Reddy, learned counsel for the petitioner and Mr. R. Venkatesh, learned standing counsel for the respondents No.2 and 3 - GHMC.
Learned counsel for the petitioner submitted that building permission was granted to the parents of the petitioner vide File No.816 (821/5/22/96) vide Permit No.42/18 and File No.816 (821/5/22/96) vide Permit No.42/16 dated 42/16 and after their death, only repair work is undertaken and except constructing stair case, no other construction was raised.
Learned standing counsel for GHMC submitted that complaint dated 06.04.2026 was received from the Archaeological Survey of India, Office of the Conservation Assistant, Charminar, Hyderabad and the site of the petitioner was inspected and it was found that illegal and unauthorized construction of ground floor was made and columns were also raised in the property. As such, show cause notice dated 19.05.2026 was issued and thereafter, speaking order dated 11.06.2026 was passed.
In the circumstances, this Court is not inclined to entertain the writ petition. However, the speaking order dated 11.06.2026 shall remain suspended for a period of three (3) weeks in order to enable/provide an opportunity to the petitioner to take steps for filing statutory appeal or regularization application.
The writ petition is disposed of. The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs.
