Judgment
This application seeks execution of order dated 11.09.2020 in OA 59/2020, Dr. Ajay Kumar & Anr. v. Union of India & Ors. whereby the Tribunal, after considering the action taken report dated 04.09.2020 filed by the District Magistrate, Meerut, Meerut Development Authority (MDA), Municipal Commissioner, Meerut and UP State PCB, directed removal of unauthorized constructions from open spaces/parks at Meerut.
The applicants thereafter filed Execution Application no. 10/2021, Dr. Ajay Kumar & Anr. v. Union of India & Ors. seeking to enlarge the scope of the matter by mentioning that there were more illegal constructions. The application was disposed of on 25.06.2021 with liberty to the applicants to approach the MDA and thereafter the Oversight Committee constituted by this Tribunal to oversee compliance of certain orders of this Tribunal, OA No. 670/2018, Atul Singh Chauhan v. Ministry of Environment, Forests and Climate Change & Ors. headed by Justice S.V.S. Rathore, former Judge of Allahabad High Court.
The present application is repeat of EA 10/2021 without any change in situation. No particulars of alleged encroachments are given nor alleged encroacher has been impleaded. None appears for the applicants. Though the Tribunal has not issued notice on the application, learned Counsel for the MDA has volunteered to appear to submit that further action in the matter is being taken.
Since there is no new development after the order dated 25.6.2021 in EA No. 10/2021, this application cannot be entertained and is disposed of with liberty to the applicants to take their remedy in accordance with law, in terms of the said order, giving necessary particulars of the violations and the violators.
