Judgment
In this Execution Application, Applicant has prayed for compliance of the order dated 06.04.2023 passed in OA No. 219/2023 whereby the Tribunal had disposed of the OA observing as under:-
“3. In the present application, it is stated that inspite of orders of this Tribunal, the violations are continuing. In absence of individual violators being party, we are of the opinion that appropriate course will be to direct the District Magistrates, Prayagraj and Kaushambi to look into the matter and take action as per law in the light of earlier directions of the Tribunal”
Submission of learned counsel for the applicant is that the above direction of the Tribunal is not complied with and there are several violations and instances of illegal mining but on the perusal of the E.A, we find that no such details have been disclosed.
Learned counsel for the applicant seeks permission to withdraw the E.A with liberty to file an appropriate application along with the complete particulars.
The prayer is allowed. E.A is dismissed as withdrawn with the liberty as prayed.
