Judgment
The grievance of the applicant is illegal mining in river Yamuna, Prayagraj, Uttar Pradesh highlighted in “Dainik Jagaran” dated 23.05.2023. The contention of the applicant is that the illegal mining is being done by use of JCB and Poclain machines in the river Yamuna at more than 66 places in District Kaushambi without any permission from the competent authority in violation of environmental rules.
A copy of this application is forwarded to the District Magistrates, Kaushambi and Prayagraj with direction to ensure that there shall not be any violation of environmental rules and will not be any mining without permission from the competent authority and in case it is found that there is illegal mining, the District Magistrates/State PCB is directed to take necessary action in accordance with law. SSMG 2016 and EMGSM, 2020 and the directions passed by this Tribunal in OA No. 219/2023, OA No. 203/2021 and OA No. 670/2018 require to be implemented and strictly complied with.
With these observations and directions, the application stands disposed of.
