Judgment
This application seeks execution of order of this Tribunal dated 23.07.20219 in O.A. No. 736/2018 on the subject of removal of encroachment from the public park at Sai Puram, Delhi Road, Meerut, Uttar Pradesh. By the said order, the Tribunal directed the District Magistrate, Meerut to take remedial measures against the encroachment. It was noted that mere pendency of appeal before higher forum was no ground not to proceed further since there was no stay in pending appeal.
In the application now filed it is stated that no action has been taken by the District Magistrate in the light of order of this Tribunal even though the appeal of the encroacher has been dismissed vide order dated 20.09.2021.
In view of above, let District Magistrate, Meerut look into the matter and take necessary action in accordance with law. An action taken report be filed within two months by e-mail with the Registrar General of this Tribunal at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF. If found necessary, the matter may be placed before the Bench.
Subject to above, the application is dismissed.
