Dilip Paul vs State Of Tripura

Heard Mr. J. Bhattacharjee and Mr. S. Ghosh, learned counsel appearing for the petitioner as well as Mr. R. Datta, learned P.P. appearing for the State-respondent.

This application has been filed by the petitioner on behalf of accused Md. Abdul Malik, who has been implicated in connection with the Dharmanagar PS Case No. 2020 DMN 040 [renumbered as P.R.C. (WP) Case No. 43/2020] under Sections 468/471 of the Indian Penal Code and Section 3 of the Indian Passport Act (Entry into Indian amendment, 2000), which is now pending before the learned Chief Judicial Magistrate, Dharmanagar, North Tripura.

Mr. Bhattacharjee, learned counsel appearing for the petitioner has submitted that the accused has been in jail custody since 18.03.2020 i.e. for about 90 days. Charge-sheet has already been submitted in connection with this case. He has further submitted that the accused is a permanent resident of Tripura and the accused is ready to provide two sureties if he is released on bail.

Mr. Ratan Datta, learned P.P. has submitted that if the petitioner is released on bail, then, there must be one surety who should be a Govt. employee.

Considering the aforesaid submissions, I am inclined to release the accused Md. Abdul Malik on bail, particularly, due to COVID-19 situation in the State.

Accordingly, the accused, Md. Abdul Malik, shall be released on bail by furnishing a bail bond of `50,000/- (Rupees fifty thousand) with two sureties of like amount, one of which must be a Govt. employee, to the satisfaction of the learned Chief Judicial Magistrate, Dharmanagar, North Tripura, on condition that he shall appear before the trial Court on each and every dates of proceedings; shall not leave the jurisdiction of Dharmanagar Police Station and to make himself available to the Officer-in-Charge or any other recognized police officer of the same P.S. once in a week.

With the aforesaid direction and observation, the instant bail application stands disposed.
