Judgment
Arindam Lodh, J
Heard Mr. S. Lodh, learned counsel appearing for the petitioner as well as Mr. Ratan Datta, learned PP assisted by Mr. S. Ghosh, learned Additional PP appearing for the State-respondent.
This is an application filed under section 439 Cr.P.C. for granting bail to the accused in connection with West Agartala PS case no. 2022 WAG 141 registered under sections 468/471 of the Cr.P.C.
Mr. Lodh, learned counsel for the petitioner has submitted that the accused is a businessman and he frequently visits India from Bangladesh. The accused is a citizen of Bangladesh. The allegation is that he put false immigration seal of India on his passport. Mr. Lodh, learned counsel also has also submitted that the accused is in custody for more than 42 days.
I have perused the case record.
Considering the nature of the case, I am inclined to release the accused person on bail.
Accordingly, I direct the accused, Md. Imran Hossain to be released on bail on the following conditions:-
(i) The accused shall deposit an amount of Rs. 5 lakh in cash as security before the concerned court, or the accused shall furnish a bond of Rs. 5 lakh with one surety of the like amount who must be a government employee;
(ii) The accused shall co-operate with the investigating agency in all respects.
It is made clear that if the accused fails to face the trial, the security amount, so deposited, shall be forfeited.
With this observation and direction, the instant application stands allowed and disposed of.
