Judgment
Heard Mr. S. Lodh, learned counsel appearing for the petitioner as well as Mr. Ratan Datta, learned PP appearing for the State-respondent.
This is an application filed under section 439 Cr.P.C. for granting bail to the accused-persons who were arrested on 02.06.2020 in connection with Dharmanagar PS case No. 92 of 2019 under Sections 148/149/ 120B/326/307/379/435 of the IPC and under Section 27 of the Arms Act.
Mr. Lodh, learned counsel appearing for the petitioner has submitted that the accused-persons have been implicated with the instant case out of political rivalry and there is no specific allegation against the accused-persons. Mr. Lodh, has also submitted that the accused persons had surrendered before the learned CJM, Dharmanagar, North Tripura by preferring a bail application but, their bail application was rejected by the learned CJM, Dharmanagar. Mr. Lodh, has further submitted that the accused-persons are in custody for more than 10 days.
Mr. Ratan Datta, learned PP has produced the case diary and has raised objection in granting bail to the accused-persons.
I have perused the case diary wherefrom, prima facie, I find nothing incriminating materials against the accused-persons. Hence, I am inclined to release the accused-persons on bail.
Accordingly, the accused-person, namely, Partinga Begam @ Fatinga Khatun and Gulbassa Begam be released on bail, on executing a bond of Rs. 25,000/- each with one surety each of the like amount, to the satisfaction of the Chief Judicial Magistrate, Dharmanagar, North Tripura.
However, the accused-persons, namely, Partinga Begam @ Fatinga Khatun and Gulbassa Begam shall appear before the Investigating Officer as and when called for and co-operate in the process of investigation and shall not try to temper the evidence.
With the aforesaid observation and directions, the instant application is allowed and stands disposed of.
