The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to respondent No.2 to issue him passport.
The petitioner vide application dated 22.06.2023 has applied for passport. The petitioner is a 71 years old man. An FIR No.184 dated 07.04.2003, was registered under Sections 341, 323, 506, 34 IPC at Police Station Shimlapuri, District Ludhiana against him. He filed CRM-M-33156-2019 before this Court seeking quashing of the aforesaid FIR. This Court vide order dated 07.04.2022 has stayed further proceedings arising out of the aforesaid FIR.
Ms. Ayushi Sharma, Advocate, for the respondents submits that on account of adverse police report, the respondent No.2 had issued show-cause-notice dated 31.07.2023 to the petitioner, however, he has not filed reply. Thus, the respondent is unable to process application of the petitioner.
Faced with this, counsel for the petitioner submits that the petitioner has not received alleged show-cause-notice.
Counsel for respondent is hereby directed to handover copy of show-cause-notice during the course of the day to Ms. Neetu Singh Aashat, Advocate.
The petitioner shall file reply to the aforesaid show-cause notice and appear before the passport authority on 21.02.2024 alongwith requisite documents. On doing so, the passport authority shall decide application of the petitioner within six weeks thereafter.
The petition stands disposed of.
