Heard both the sides.
This bail application has been filed on behalf of Bhola Bharti who is in custody since 10.08.2025 in connection with Pratappur P.S. Case No. 72 of 2025 for the offence registered under Sections 103(1) & 3(5) of the BNS, 2023 pending in the Court of learned S.D.J.M., Chatra.
As per the FIR, deceased Kailu Bhuiyan was murder in cold blood by knife because of the land dispute with the named accused persons.
It is submitted by learned counsel for the petitioner that there is no direct eye witness to the incident and the case is based on circumstantial evidence. The only material is the disclosure statement made by co-accused Pankaj Bharti on the basis of which, the weapon of offence is said to be seized. So far as this petitioner is concerned, except the confessional statement made by the co-accused, there is no other materials against him.
Learned A.P.P. for the State opposed the prayer for bail.
Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
