Heard the learned counsel appearing for the petitioner and learned counsel appearing on behalf of the respondent State.
This application has been filed for grant of regular bail to the petitioner in connection with Mango P.S. Case No.245 of 2024, corresponding to S.T. Case No.43 of 2025, registered for the offence under sections 191(1), 191(3), 190, 126(2), 127(2), 103(1), 109, 118(1), 117(2), 118(2), 324(4), 324(5), 352, 351(2), 351(3), 61(2) of BNS, 2023 and section 27 of Arms Act, pending in court of learned Additional Sessions Judge III, East Singhbhum, Jamshedpur. 3. The learned counsel appearing for the petitioner submits that on his own confessional statement of the petitioner and the confessional statement of the coaccused it is established that the petitioner was present at the place of occurrence. She submits that the petitioner has fired on the waist of the deceased whereas coaccused namely Mohanti Singh Sardar shot the deceased on his head resulting in his death. She further submits that the Mohanti Singh Sardar has been granted bail in B.A. No.3300 of 2025 by the coordinate Bench of this Court. She next submits that now the charge has also been framed and however till date no witness has been examined. She next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.14 and the petitioner is in custody since 06.09.2024.
The learned counsel appearing on behalf of the respondent State opposed the prayer of regular bail of the petitioner and submits that allegation of firing is there against the petitioner.
Considering that the petitioner has fired shot on the waist of the deceased and the coaccused namely Mohanti Singh Sardar has fired shot on the head of the deceased resulting to his death and he has been granted regular bail by the coordinate Bench and the charge has already been framed and till date no witness has been examined and petitioner has got no criminal antecedent as disclosed in paragraph no.14 and the petitioner is in custody since 06.09.2024, I am inclined to grant regular bail to the petitioner.
Accordingly, petitioner, above named, is hereby directed to be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Additional Sessions Judge III, East Singhbhum, Jamshedpur, in connection with Mango P.S. Case No.245 of 2024, corresponding to S.T. Case No.43 of 2025.
