The applicant who is in custody since 20.07.2023 has approached this Court for grant of regular bail in connection with Chatra Sadar P.S. Case No.259 of 2017, registered for the offence under Sections 147/ 148/ 149/ 341/ 323/ 504/ 302 of IPC, Sections 25(1-B)a/ 26/ 27/ 35 of the Arms Act and Section 17(i)(ii) of the C.L.A. Act, pending in the court of learned C.J.M., Chatra.

The applicant is an accused of committing murder.

It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part.

Innocence has been claimed and undertaking has been given for participation in the trial. It has been submitted by learned counsel for the applicant that as per the allegation there was firing between two extremists group. He has been roped in this case only on the basis of confession. Except that fact, there is no other material against this applicant. On above basis prayer for bail has been made.

Learned A.P.P. has opposed the prayer for bail of the applicant.

Considering the fact that except confession, there is no other material against this applicant, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Chatra in connection with Chatra Sadar P.S. Case No.259 of 2017, subject to condition that one of the bailor will be the family members of this applicant and the applicant will report to the concerned police station once in a month till the conclusion of trial. Further, the applicant will submit self-attested copy of his Aadhaar Card and also give his mobile number before the learned court below which he will not change during pendency of this case without prior permission of the court.
