The matter is taken up for hearing by way of praecipe filed by the appellant for seeking urgent relief.

The Learned Counsel for the Appellant/Applicant would submit that the matter has been settled between the parties and seeks permission to withdraw the pre-deposit amount which is lying in the Registry, DRAT, Mumbai.

The Learned Counsel for the Respondent No.1/Bank has no objection to the same.

Accordingly, the M.A. Diary No. 1281/2026 is allowed.

The Registry is directed to refund the amount along with accrued interest, if any, to the Appellant/Applicant.
