The matter is taken up for hearing by way of praecipe filed by the appellants for seeking urgent relief.
The Learned Counsel for the Appellants would submit that the matter has been settled between the parties and seeks refund of the mandatory pre-deposit made under Section 18 of the SARFAESI Act which is lying with the Registry of DRAT, Mumbai.
Not objected to by the Respondent.
Accordingly, M.A. No. 57/2026 is allowed. The Registry is directed to refund the pre-deposit amount along with accrued interest, if any to Appellants.
All pending I.As. if any, stand dismissed.
