Heard Shri Anil Kumar Singh, learned counsel for the applicant and Shri Amitabh Kumar Sinha, learned counsel representing the respondents.

The instant Contempt Petition U/S 17 of the Administrative Tribunal Act, 1985 was filed for non-compliance of the order dated 04.04.2025 passed in O.A. No.887/2024 whereby the following directions were given:-

“….11. Thus, in view of the aforesaid deliberations and analysis, the instant case of the applicant is liable to be allowed at this stage itself. Accordingly, the instant original application is allowed. Respondents are hereby directed to accord positive consideration to the candidature of the applicant and allow him to join duties in accordance with the appointment order already issued to him, if he is otherwise found eligible. The aforesaid exercise shall be carried out by the respondents within a period of three months from the date of receipt of certified copy of this order. However, it is made clear that his appointment shall remain subject to the outcome of the criminal case lodged against him which is still pending.”

Compliance affidavit has been filed from the side of the respondents on 21.09.2026 and in para 6 onwards of the affidavit, it is stated that the aforesaid order of the Tribunal dated 04.04.2025 has been fully complied with.

Learned counsel for the applicant admitted the said position.

In view of the above, the instant Contempt Petition is dismissed and consigned to record. Notices, if any, issued to the respondents have been discharged.

M.A., if any, stand disposed of, accordingly.
