Judgment
This Original Application has been registered under Section 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) on a letter petition dated 11.12.2022 sent by Smt. Arti Singh and other villager of Jigna Jaganath (Badka Jigna) PS Meerganj, District Gopalganj, State of Bihar.
The grievance is that Shri Brijmohan Singh S/o Late Bhim Singh is running two poultry farms in the village in utter violation of environmental norms and laws, causing huge air pollution in the village, creating health hazards to the local inhabitants and villagers. It is said that poisonous gases and bad odour are being emitted from the poultry farms which are not being managed scientifically and therefore, serious pollution is being caused in the area concerned.
In our view the issue raised in this application, at the first instance can be looked into by the local authorities, hence we constitute a joint Committee comprising District Magistrate Gopalganj and State PCB to look into the compliant, visit the site, collect relevant information and if finds the complaint to be correct, take appropriate remedial preventive and other action in accordance with law, for maintenance of clean environment and if there is any damage to environment, for its restoration within two months.
State PCB shall be the nodal agency for coordination and compliance of this order.
With the above direction/observation the applicant is disposed of.
A copy of this order be forwarded to State PCB and District Magistrate, Gopalganj by e-mail for compliance.
