Judgment
This Original Application (hereinafter referred to as ‘OA’) under Section 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered by exercising suo-motu jurisdiction based on a letter petition dated nil sent by Om Pal Singh son of Ram Pal Singh resident of Subhash Nagar, Mahoba District, Uttar Pradesh and signed by some other persons stating that Ram Babu Gupta and Munna Gupta, sons of Rameshwar Gupta, resident of Balkhandeshwar are running Daal Mill and Peanut Mill, causing pollution. On account of functioning of above mills, air is getting polluted causing health hazards to the residents and even people residing in nearby area facing difficulty in breathing and respiration. Pollution is continuing for last one year and despite complaint made to concerned authorities, no action has been taken.
In our view, the complaint can be looked into at the first instance by concerned authorities at the local level for which we constitute a Joint Committee comprising State Pollution Control Board and District Magistrate, Mahoba.
District Magistrate, Mahoba shall be the nodal agency for coordination and compliance.
The said Committee shall visit the site, collect relevant factual information and, if it finds any violation of environmental laws or norms, would take appropriate remedial, preventive and punitive action against the erring persons in accordance with law and submit a factual report with Registrar General of Tribunal within three months by e-mail at judicial-ngt@gov.in preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF. If found necessary, the matter will be listed for consideration before the Bench.
With the above directions, OA is disposed of.
A copy of this order be forwarded to State Pollution Control Board and District Magistrate, Mahoba by e-mail for compliance.
