Judgment
A. Guneshwar Sharma, J
Heard Mr.N.Ibotombi, learned senior counsel assisted by Ms.Savitri, learned counsel for the petitioner, Mr.Y.Ashang, learned Government Advocate for the State and Mr.Anjan Prasad Sahu, learned counsel for the Manipur University.
The prayer in the writ petition is for a direction for re-evaluation of Anatomy Theory Part-I & II with a prayer for giving the benefit of regularization.
Issue notice.
Mr.Ashang, learned Government Advocate accepts notice on behalf of respondent Nos.1 and 2 and Mr.Anjan Prasad Sahu, learned counsel accepts notice on behalf of respondent Nos.3, 4 and 5. Hence, service is complete.
Learned counsel for the respondents pray for three weeks’ time for filing counter affidavit.
Mr.N.Ibotombi, learned senior counsel prays for relying on MC (WP(C)) No.2 of 2025.
It is submitted that the petitioner has submitted a representation and the same still pending. It is submitted that during pendency of the writ petition the Manipur University may be directed to dispose of the representation.
Mr.Anjan Prasad Sahu, learned counsel for the Manipur University submits that innocuous direction for disposing the representation as per law may be given by this Court.
Mr.Y.Ashang, learned Government Advocate submits that this Court may pass appropriate order in the interim matter.
Considering the submissions made at the Bar, it is clarified that there is no bar on the Manipur University to consider and dispose of the representation submitted by the petitioner, during pendency of the writ petition by passing speaking order preferably within a period of two weeks.
It is clarified that this Court does not express any opinion on the merit of the representation submitted by the petitioner.
List this case before the roster Bench on 10.02.2024.
Furnish a copy of this order to learned counsel for the parties.
