Judgment
Application under the provisions of the National Green Tribunal Act, 2010.
The applicant- Ali Mullah resident of Patti Jaid Back Side Joti Model School Longowal Distt. Sangrur has filed the present application under the provisions of the National Green Tribunal Act, 2010 alleging that Mr. Parmod Kumar and his father Shiv Shanker tried to cut one very old and green tree existing in common land and he stopped them from doing so with great difficulty . He made complaints to D.C. Sangrur , EO Municipal Committee, Longowal and Forest Department Sangrur. Mr. Parmod Kumar and his father Shiv Shanker are trying again and again to cut the tree completely with the help of Municipal Committee officials. The applicant has attached photographs taken on the site in support of averments made in the application.
Prima facie, the averments made in the application raise questions relating to environment arising out of the implementation of the enactments specified in Schedule I to the National Green Tribunal Act, 2010.
In view of the averments made in the application, we consider it appropriate that a Joint Committee be constituted to verify the factual position and take appropriate remedial action. Accordingly, we constitute a Joint Committee comprising of EO, MC, Longowal and DFO and District Magistrate, Sangrur and direct the same to meet within two weeks, undertake visit to the site, look into the grievances of the applicant, hear the applicant and respondent no. 2, verify the factual position and take appropriate remedial action by following due process of law within two months.
Factual and Action taken Report may be submitted within three months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF, before the Ld. Registrar General, National Green Tribunal, Principal Bench, New Delhi who may, if necessary, put up the matter before the Bench for further directions.
The application is disposed of accordingly.
A copy of this order, along with a copy of the application and documents attached with the same, be forwarded to EO, MC, Longowal and DFO and District Magistrate, Sangrur respectively by e-mail for requisite compliance.
