Judgment
This Original Application has been registered under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) exercising suo-moto jurisdiction on the basis of letter petition dated 15.09.2023 sent by Sh. Akash Poddar, partner M/s Black Diamond Resources, Block No. 334, 354, 355, 356 Village Tancha-Sudi, Near Solarism, District Bharuch, State of Gujarat alleging that in Bharuch, there is large scale violation in handling, management and storage of ammonium nitrate causing contamination.
We find that Original Application has been made by a complainant who is a proponent who has all resources available and if had any grievance could have filed proper application in accordance with rules before Tribunal.
Further, we find that allegations are very vague and general. Neither, it is mentioned who is causing such violation nor other details are given. In absence of details of the alleged violations of the environmental laws and on vague and unspecified complaint, we do not find it a fit case to proceed further.
The application is accordingly rejected.
However, the applicant is given liberty to move appropriate application before the appropriate bench in accordance with rules with more specific details if there is any violation of environmental laws.
