Judgment
This original application under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as “NGT Act, 2010”) has been registered exercising suo motu jurisdiction taking cognizance on a letter petition dated 17.08.2023 along with which a letter dated 13.06.2023 has been appended alleging that a Builder M/s. Sare Homes (Springview floors) is disposing STP water in open and causing harm to air quality and underground water.
It is not the case of complainant that STP water is untreated or there is any violation of environmental law. Once it is admitted that an STP is there and it is treating water, then water has to be utilized for various purposes including horticulture and that by itself is no violation of any environmental laws.
The complainant has also appeared in person and when pointed out this fact he said that actually untreated water is being discharged from the STP and STP is not functioning, but this fact is not stated in the complaint made before us.
At this stage, complainant says that he may be permitted to withdraw this complaint with liberty to file appropriate complaint in accordance with law.
The application is accordingly dismissed with the aforesaid liberty.
