Judgment
This original application under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered on a letter petition dated 26.06.2022 sent by Shri Mritunjay Narayan Jha, Secretary, NEPRWA, Nirala Eden Park, GH-05, Ahinsha Khand-II, Indirapuram Ghaziabad.
The grievance is that about 430 families are residing in the said society whereat a sewerage pumping station has been established which is emanating foul smell and hazardous gases which may affect health of residents. It is also said that a new high power generator has been installed at the said sewerage plant which is causing noise pollution also.
So far as establishment of STP is concerned, it is not case of the applicants that it is in violation of any provisions of environmental laws or norms and in absence of any such violation, the establishment of STP, per se, cannot be faulted. However, so far as noise pollution is concerned, in our view that can be looked into by State PCB and if State PCB finds that necessary remedial precautions have not been taken to avoid noise pollution, it shall take appropriate remedial measures in the matter within two months.
An action taken report may be submitted to Registrar General of this Tribunal by e-mail at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF. If found necessary, the matter may be placed before the Bench for further directions.
With the above observations and directions, the application is disposed of.
