Application is registered based on a complaint received by post/e-mail
This original application has been registered under Section 14 & 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) on a letter petition dated 03.08.2022 received from Gram Panchayat, Bitchidonaa, Panchayat Samiti, Tehsil Malarna- Dungar District Swai Madjopur, Rajasthan.
The complaint is that in Villages Bitchidonaa, Bilauli, Shyamoli, Bhuka, Padana and Badolas, Malarna Station, etc., illegal mining of bajri in heavy quantity is being carried out to the extent that about 50-60 trucks and dumpers and 400 tractors containing illegally mined bajri are running everyday but no action is being taken by the authorities. The applicant also says that there is an order passed by Hon’ble Supreme Court in SLP No. 10587/2019, Bajri Lease LOL Holders Welfare Society v. The State of Rajasthan & Ors. wherein, Hon’ble Supreme Court vide order dated 12.05.2022 has directed State Government to file an affidavit giving particulars of the steps taken to arrest illegal mining and to stop transportation of illegally mined minerals.
It is thus evident that Hon’ble Supreme Court has already taken cognizance of matter and that being so, we do not find it necessary to take any action on this letter petition filed before Tribunal. Applicant is free to take remedy by joining proceedings before Hon’ble Supreme Court.
Application is disposed of.
