This Original Application under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered, exercising suo moto jurisdiction based on a newspaper report published in daily newspaper Amar Ujala dated 28.01.2024 under the title " Rajasthan News "avaidh khanan ke khilaaf pradeshvyapi abhiyan ke tehet 24 ton avaidh bajri samaet garnaet zapt jaanch jaari ".

Report says that there is illegal mining and extraction of minerals in Bhilwara District, State of Rajasthan and authorities have seized a number of vehicles loaded with sand and bjri, illegally mined, but no adequate, appropriate, remedial preventive and punitive action has been taken against the persons who are indulged in illegal mining.

In our view, the facts noticed above give rise to a substantial question relating to environment arising due to implementation of scheduled enactments under NGT Act, 2010. However, before taking any further action in the matter, we find it appropriate to obtain a factual report to which we constitute a joint committee comprising State PCB, Collector Bhilwara and CPCB.

Collector Bhilwara shall be the nodal agency for coordination and compliance.

Aforesaid committee shall visit the site, collect relevant information and submit factual report within two months.

Since, matter relates to State of Rajasthan, therefore, it is transferred to Central Zonal Bench of the Tribunal for further consideration.
