Judgment
On a mention being made by the learned counsel for the applicant, this case has been taken up today.
Heard the learned counsel for the applicant.
Learned counsel for the applicant has shown a demand draft no. 085347 dated 25.06.2026 for Rs. 5.60 lakhs, but the said D.D. is prepared in favour of Edelweiss Assets Reconstruction Company Limited, therefore, the same cannot be encashed for the purpose of preparing the FDR. Hence, the appellant is directed to get back the same and get it prepared in favour of Registrar, DRAT, Allahabad and the same be submitted before the registry by Monday i.e. 06.06.2026.
Learned counsel for the appellant also submits that the Bank is going to take possession of the property in question today i.e. 30.06.2026. It is, therefore, prayed that the interest of the applicant may be protected.
After hearing the learned counsel for the applicant and considering the facts and circumstances of the case, since the matter is still pending before the Tribunal below, therefore, the present misc. application stands disposed of with liberty to the applicant to move an appropriate application for redressal of his grievances within 10 days from today. In case the applicant files an interim application before the Tribunal below within the stipulated period, the same shall be considered and decided on the same day or preferably within 10 days thereafter. Till that time or disposal of the said application, whichever is earlier, the status quo qua the property in question, as it exists today, shall be maintained by all the parties concerned. It is made clear that if the applicant does not deposit the corrected demand draft before this Tribunal by Monday i.e. 06.07.2026, the aforesaid interim relief given by this Tribunal shall stand automatically vacated.
