Judgment
On a mention being made by the learned counsel for the applicant, the present case has been taken up today.
Heard the learned counsel for the applicant on the misc. application.
Learned counsel for the applicant has filed the present misc. application for direction to the Tribunal below to decide the stay application as well as the amendment application filed in S.A. No. 79/2022 within the time as stipulated by this Tribunal.
Learned counsel for the appellant has deposited a demand draft of Rs. 3.00 lacs before this court today and further summed that after issuance of demand notice, Rs. 10.00 lacs was also deposited. Let the said amount be kept in the form of FDR in the nationalized Bank for a period of one year in auto renewal scheme.
Learned counsel further prayed that the interim protection may be granted as the Bank is going to take possession of the property in question on 12.03.2026.
In view of the above, let the matter be mentioned before the Tribunal below on the date fixed for the relief as claimed by the applicant in the present case and it is expected that the Tribunal below shall consider and decide the aforesaid applications, which are stated to be pending, on the same day or preferably within 10 days thereafter. Till then, the status quo qua the property in question, as it exists today, shall be maintained by all the parties concerned.
In the above terms, the present misc. application stands disposed off.
